Drugs and medicines are frequently the subject of a manufacturer’s recall notice especially when unexpected side effects that were not envisaged upon development and testing of the drug become apparent. Manufacturers of these products, who are usually insured against these problems, have a legal responsibility to test drugs and medicines before releasing them to consumers using testing criteria imposed by the Medicines and Healthcare Products Regulatory Agency (MHRA) which is accountable to Health and Agriculture Ministers in the UK Government. The MRHA imposes controls regarding the safety, efficacy and quality of the product and supervises clinical trials, advertising claims and the supply of imports and is required to take action when adverse effects are recognised. The MHRA has no effect on the manufacturer's liability to an injured claimant if the drug proves to be defective.
