This condition is caused by breathing in a fine spray of water which carries the legionella pneumophila bacterium. There is no evidence that this disease is transmitted from person to person or from drinking water carrying the bacterium. There are probably in the region of 200 cases of this dangerous health condition each year in the UK. The problem starts with high fever, chills, headache or muscle pain and subsequently a dry cough and pneumonia which in some cases is fatal.

The legionella pneumophila bacterium is often found in hot water systems and infection is caused by breathing contaminated water sprays from equipment including air conditioning plant, cooling towers, industrial sprays and showers. Outbreaks usually occur near large building complexes such as hotels, hospitals, offices and factories which have defective or poorly maintained equipment, plant or machinery.

When the legionella pneumophila bacterium is dispersed through a fine spray it often contaminates the entire area around a building and as a result infects a large number of people. Investigations and tracking the movements of sufferers will often reveal a common location that in due course identifies the source of the infection. It may be possible to prosecute under the Health & Safety at Work Act 1974 or the Control of Substances Hazardous to Health Regulations 1988 if the owner of the faulty equipment has not complied with the Approved Code of Practice for the equipment in question. The risks and hazards of Legionnaires Disease are, or should be, well known to the operators of large buildings or of spray equipment who will be held liable to pay compensation to anyone who suffers personal injury or loss as a result of contracting this disease
